These Terms & Conditions constitute the entire agreement between you and Best Damn Merch regarding your use of this Website and supersede any prior agreements or understandings relating to such use. By accessing or using the Best Damn Merch website, placing an order, or purchasing products from us, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use our Website. Our failure to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision or any other rights. Any contests, giveaways, sweepstakes, promotions, or special offers conducted by Best Damn Merch may be governed by separate rules in addition to these Terms & Conditions.

These Terms & Conditions govern your use of the Website and all purchases made through Best Damn Merch ("we," "us," or "our").We reserve the right to update, modify, or replace these Terms & Conditions at any time without prior notice. Changes become effective immediately upon posting to the Website.

2. Products & Availability

All products are subject to availability. We reserve the right to modify, discontinue, or update products, pricing, descriptions, and availability without notice. Product photographs and mockups are intended to represent the final product as accurately as possible. However, actual products may vary slightly due to printing methods, garment dye lots, manufacturing differences, screen settings, and other factors beyond our control.

3. Order Processing & Fulfillment

Most products are produced after an order is placed using a made-to-order production process. Typical production time is 3–5 business days, although production times may vary due to order volume, equipment maintenance, supplier availability, holidays, or other unforeseen circumstances. An order is not considered accepted until payment has been successfully processed. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders affected by pricing errors, website errors, suspected fraud, or inventory inaccuracies.

4. Shipping & Delivery

We ship to locations supported by our shipping carriers. Shipping times are estimates only and are not guaranteed. Once an order has been transferred to the shipping carrier, delivery times and shipping performance are outside of our control. Best Damn Merch is not responsible for shipping delays caused by: postal carriers, weather events, customs processing, supply chain disruptions, incorrect shipping information provided by the customer, or other circumstances beyond our controlI. If a package is delayed, lost, or marked as delivered but cannot be located, we will make reasonable efforts to assist the customer in working with the carrier. Customers are responsible for providing accurate shipping information. Orders returned due to an incorrect address may require additional shipping charges before reshipment.

5. Returns, Replacements & Refunds

Due to the made-to-order nature of our products, all sales are final. We do not accept returns, exchanges, or refunds for: incorrect size selection, ordering mistake, color preference, buyer's remorse, or changes of mind. However, we will replace products at no additional cost if: the incorrect item was received, the item arrives damaged, the item arrives defective, or the item contains a production error caused by us. To request a replacement, customers must contact us within 15 days of receiving their order and provide photos and a description of the issue. Depending on the situation, customers may be required to return the incorrect item before a replacement is issued. If a return is required, we will provide a prepaid return label.

6. Sizing & Product Variations

Customers are responsible for reviewing product descriptions, measurements, and size charts before purchasing. Because products are made to order, we cannot offer refunds or replacements due to incorrect size selection. Minor variations in: color, garment construction, print placement, material texture, and product dimensions are considered normal and do not qualify as defects.

7. Intellectual Property

All artwork, logos, trademarks, band names, podcast names, graphics, images, and other content displayed on this website remain the property of their respective owners. No content from this Website may be copied, reproduced, modified, distributed, sold, or used without proper authorization from the applicable rights holder.

8. Artist Merchandise

Best Damn Merch serves as a production and fulfillment partner for artists, bands, podcasts, creators, and other brands. All opinions, statements, artwork, music, podcasts, videos, and other content associated with participating artists remain the responsibility of those artists and creators. Best Damn Merch does not necessarily endorse or share the views expressed by artists or creators featured on this Website. Any artist fulfillment agreements, storefront arrangements, exclusivity agreements, or revenue-sharing arrangements are governed by separate agreements and do not affect customer purchases made through this Website.

9. Website Use & Conduct

By using this Website, you agree not to: violate any applicable laws or regulations, attempt unauthorized access to any part of the website, interfere with website operations, upload malicious software or harmful code, submit fraudulent orders, copy, distribute, or misuse Website content without permission. We reserve the right to restrict access, suspend accounts, cancel orders, or take other action if these Terms & Conditions are violated.
